- PREAMBULE
1.1 These are the Terms and Conditions of Ginger Monkeys, which apply to all orders placed via the online store at the www.gingermonkeys.nl. Please read these Terms and Conditions carefully.
1.2 By placing an order, these Terms and Conditions are accepted. In case one or more provisions of these General Terms and Conditions are void or being declared invalid, the remaining provisions of these General Terms and Conditions shall remain in full force and effect. The void or invalid provision(s) shall be replaced by Ginger Monkeys, taking into account the purpose and intention of the original provision(s) to the extent as possible.
- OFFERS
2.1 Offers on the www.gingermonkeys.nl are free of engagement and offers are valid as long as stock lasts.
2.2 Offers do not automatically apply to future orders.
2.3 Apparent errors or mistakes in the information on the www.gingermonkeys.nl are not binding on Ginger Monkeys.
- ORDERS
3.1 Once an order has been placed, Ginger Monkeys sends an email to confirm the details of the order and the total costs associated with the order.
3.2 An agreement is only concluded once the payment of the total costs associated with the order has been successful.
3.3 Ginger Monkeys is entitled to refuse an order or to add specific conditions to the delivery of the order.
- PRICES AND PAYMENT
4.1 All prices mentioned on the www.gingermonkeys.nl are in Euro and include Dutch VAT (21%).
4.2 Shipping costs and any import duties are not for the account of the Ginger Monkeys and not included in the prices mentioned on the www.gingermonkeys.nl.
4.3 Shipping costs will be clearly set out before the placement of the order can be confirmed.
- DELIVERY
5.1 Shipment of the order will take place once Ginger Monkeys has received payment for the order, to the address provided.
5.2 Ginger Monkeys strives to ship orders within 3 working days after receipt of the payment of the order.
5.3 If Ginger Monkeys is not able to ship the product within 30 days after placement of the order, the order can be canceled free of charge.
5.4 Ginger Monkeys shall send an e-mail with information regarding the status of the delivery of the order.
5.5 Any import duties, customs formalities and taxes in connection with the order are not for the account of Ginger Monkeys.
5.6 The ownership of the products part of the order and the associated risk transfers to the consumer at the moment the consumer has received the product.
- RETURNS
6.1 Orders can be canceled without stating reasons within 14 days from the date of delivery.
6.2 This right of cancelation is included in the order confirmation.
6.3 All items must be returned in its original packaging and with the original hangtags. 6.4 Ginger Monkeys will not accept returned items that have been washed, worn, stained, damaged or altered in any way. Such items will be returned to the sender. The costs of these items will be refunded, minus the shipping costs for returning the items.
6.4 All returns should be accompanied by a note with the order number, reason of return and wish for exchange or refund.
6.5 Returns should be send to the following address, clearly indicating the name and address of the sender:

6.6 Ginger Monkeys strives to handle returns within 5 working days from receiving. The costs of the returned items will be refunded to the same card or account that the order was paid from. Shipping costs will not be refunded.
6.7 Ginger Monkeys recommends sending your return with traceable post. Lost packages will not be refunded.
6.8 If Ginger Monkeys accidently sent a wrong item or the item appears to be damaged upon arrival, Ginger Monkeys must be notified by sending an e-mail to [email protected] as soon as possible and ultimately within 14 days from receiving the item. In such case Ginger Monkeys will refund the return shipping costs and send the correct item as soon as possible. In case the item is not available, Ginger Monkeys will also refund the costs of the item.
- RIGHT OF WITHDRAWAL
7.1 Orders in whole or items of an order can be withdrawn, for whatever reason, within 14 days after delivery of the order.
7.2 In case of withdrawal, GingerMonkeys should be informed by e-mail of the withdrawal and the items involved should be returned within 14 days after delivery of the order.
7.3 Shipping costs of the returned items are not for the account of Ginger Monkeys.

8.1 For questions and complaints regarding the online shop, an order or any the items or procedures, our customer service can be contacted by e-mail: [email protected].
8.2 Ginger Monkeys tries to reply to e-mails within three working days.
- WEBSITE
9.1 The content on www.gingermonkeys.nl has been compiled with utmost care. However, Ginger Monkeys cannot guarantee that the information on www.gingermonkeys.nl is correct.
9.2 Ginger Monkeys is not liable for the consequences of incorrect information on www.gingermonkeys.nl such as errors or mistakes.
9.3 Ginger Monkeys is not liable for damage in case of temporary unavailability of www.gingermonkeys.nl.
9.4 Ginger Monkeys is not liable for damage due to the malfunctioning of www.gingermonkeys.nl.
- PRIVACY
10.1 Ginger Monkeys will treat personal data with utmost care.
10.2 Ginger Monkeys will not share personal data to third parties, except when the data is required for the delivery of the order.
10.3 To process an order, Ginger Monkeys requires a name, invoice address, delivery address and payment details. The payment details will only be used for the payment process.
10.4 Statistics of website visits are kept for internal purposes. Information concerning the amount of visitors and the frequency of visits will be used for internal research and website improvement.
- LIABILITY
11.1 All items on www.gingermonkeys.nl have been produced with utmost care.
11.2 The colors of the items as shown on www.gingermonkeys.nl may differ from the actual colors of the items. Ginger Monkeys is not liable such color differences.
11.3 Ginger Monkeys is not liable for any accidents involving or caused by or damage caused to the items ordered on www.gingermonkeys.nl as a result of for instance incorrect use like use not in accordance with the instructions.
11.4 Ginger Monkeys cannot be held liable for indirect or consequential damage, including but not limited to loss of information, profit, turnover or savings.
11.5 In case Ginger Monkeys is liable for any damage, the liability of Ginger Monkeys is limited to the amount of the payment received by Ginger Monkeys from the insurance. In case the damage is not covered by the insurance or no insurance has been contracted by Ginger Monkeys for such damage, the liability of Ginger Monkeys is limited to the total costs of the order.
11.6 The limitation of liability as mentioned in these General Terms and Conditions does not apply in case damage is caused by intent or deliberate recklessness of Ginger Monkeys.
- FORCE MAJEUR
12.1 Ginger Monkeys is entitled, at its own choice, in case of force majeur, to cancel the order without legal intervention, by giving notice in writing. Ginger Monkeys cannot be held liable for any damages, unless given the circumstances this would be unacceptable according to measures of reason and fairness.

13.1 All information on www.gingermonkeys.nl is protected by copyright. It is not allowed to partially or wholly copy, use or distribute any information, photo or content from www.gingermonkeys.nl without prior written permission of Ginger Monkeys.
- APPLICABLE LAW AND COMPETENT COURT
14.1 Any rights, obligations, offers, orders and agreements to which these Terms and Conditions apply, are governed by Dutch law exclusively.
14.2 All disputes following from these General Terms and Conditions will exclusively be presented to the competent court in Rotterdam.
